Workers Compensation

The Missouri Division of Workers’ Compensation (DWC) administers programs for workers who have beeninjured on the job or exposed to an occupational disease arising out of and in the course ofemployment. The Division’s Administrative Law Judges have the authority to approve settlements orissue awards after a hearing relating to an injured employee’s entitlement to benefits.

Unemployment Insurance Benefits

Unemployment insurance (UI) benefits are provided under the Missouri Employment Security Law forworkers who become totally or partially unemployed, if they meet the eligibility requirements ofthe law.

Workers under age of 16 Labor Law

WORK CERTIFICATES are required for youth 14 to 15 years of age before they start employment at anyjob (other than in the entertainment industry) during the school year.

Discrimination in Public Accommodations

The Missouri Human Rights Act makes it illegal for places of public accommodation to deny access toor treat someone unequally because of an individual’s race, color, religion, national origin,ancestry, sex, or disability.

Discrimination in Employment

The Missouri Human Rights Act makes it illegal to discriminate in any aspect of employment becauseof an individual’s race, color, religion, national origin, ancestry, sex, disability or age (40through 69).

Discrimination in Housing

The Missouri Human Rights Act makes it illegal to discriminate in any aspect of housing because ofan individual’s race, color, religion, national origin, ancestry, sex, familial status (childrenunder the age of 18 living with parents or legal custodians, pregnant women, and people securingcustody of children under the age of 18), or disability.

Which Postings to Download for a Complete 2018 Missouri Labor Law Poster

The Missouri Commission on Human Rights have published different labor posters that need to be displayed in the workplace. The Missouri State Labor poster includes three separate Anti-Discrimination posters. These mandatory labor posting for Missouri include:

  1. Labor Discrimination
  2. Housing Discrimination
  3. Discrimination in Places of Public Accommodations

These Posters are available to download for free on the MO Department of Labor and Industrial Relations website. Other mandatory posters that employers are required to post include the following:

The Missouri minimum wage is set at $7.70. This past year, the Missouri Legislator passed a bill that prohibits local minimum wages, which means that the St. Louis minimum wage of $10.00 per hour has now reverted to the state minimum wage of $7.70.

Aside from the Missouri state labor law poster, employers need to display federal labor posters, even in cases where the Missouri state poster goes beyond the federal law. An example of this is the MO minimum wage of $7.70, whereas the federal minimum wage is just $7.25. The law is to follow the higher of the two wages.

Other federal posters that should be displayed along with the Missouri state labor posters include the following:

  • Employee Polygraph Protection Act Poster (government agencies are exempt from this law)
  • Uniformed Services Employment and Reemployment Rights Act (USERRA)

The Equal Employment Opportunity Poster had a new revision in 2015. This revision is only for Contractors or Subcontractors who hold contracts of over $10,000 from the federal government.

All posters should be displayed in a place where employees will be able to read their rights, such as the breakroom, lobby, or if the company has one, a company bulletin board.

The Missouri minimum wage

The minimum wage for the state went up $.15 an hour January 1, 2018. The new minimum wage is $7.85 an hour.
