Unemployment Insurance for Employees

Employers wishing to be compliant with mandatory posting requirements in Georgia take heed. Complacency is understandable given that not only has Georgia has not changed or updated its mandatory labor law notices since 2016, it has not revised its Unemployment Insurance for Employees notice since 2013! However, complacency is no excuse or for being in non-compliance.

Revised as of 06/18, the new mandatory Unemployment Insurance for Employees notice is available for free download from the Georgia Department of Labor (GDOL). The notice informs employees that their job is covered by the Employment Security Law, describes eligibility requirements, and instructs employees on how to file a claim for unemployment insurance benefits.

However, the primary reason for the new Georgia posting law and poster is to emphasize a Georgia employee’s ability to file claims for their unemployment insurance benefits online. Under the heading of "Important, the poster informs employees that "You may file a claim for unemployment Insurance benefits via the internet at dol.georgia.gov."Employees may also file their claims in person at GDOL offices all locations of which are listed on the bottom of the poster.

Remaining unchanged, is the poster making it clear for employees to know that they are covered under Georgia's Employment Security Law and that that comes with both rights and responsibilities. It makes clear that if you are an employee filing for unemployment insurance benefits then every week that you do so you must be:
  • UNEMPLOYED
  • ABLE to work
  • AVAILABLE for work
  • ACTIVELY SEEKING WORK
  • Be willing to IMMEDIATELY ACCEPT suitable work.
Additionally, every week that you claim unemployment you must
  1. Register for employment services with the Georgia Department of Labor (GDOL), and
  2. Report weekly work search contacts, all earning each week, and any job refusal.
Additionally, the poster makes it clear to employees that unemployment benefits remitted under the Employment Security Law are funded by taxes paid by the employer and that an employer may not, under any circumstances, deduct any money from employees’ paychecks to pay unemployment insurance tax. Even in states that do not update their labor posting requirements frequently, like Georgia, it is imperative for employers to keep up to date with their compliance responsibilities. Ignorance is no excuse for being unaware of the Georgia Code stating:

Employers shall post and maintain in places readily accessible to their employees all printed statements, posters, etc., released and required by the Commissioner of Labor or the Georgia Department of Labor pertaining to the rights of employees under the Employment Security Law. (Ga. Comp. R. & Regs. r. 300-2-7-.15)
