The Uniformed Services Employment and Reemployment Rights Act (USERRA) was established on October 13th, 1994. USERRA serves as a backing for the Veterans' Reemployment Rights Statute by helping Veterans understand employee eligibility and job entitlements, employer obligations, benefits and remedies instituted under the Act. USERRA is administered by the United States Department of Labor, through the Veterans' Employment and Training Service (VETS).
This act protects all individuals in the US who have served, or presently serve, in the uniformed services and are applying or returning to employment in the public and private sectors, including Federal employment. USERRA also provides protection for disabled veterans and makes it mandatory for employers to make judicious efforts to accommodate the veterans' disability. The Uniformed Services Employment and Reemployment Rights Act prohibits possible employer discrimination based on one's military position or former service responsibilities. It also provides employees with Department of Labor assistance in processing claims.
Employers are required to provide information regarding USSERA to current or potential employees who are eligible for benefits under USERRA. This includes a notice of the rights, benefits and obligations for those entitled. A suggestion for employers could be to post the notice "Your Rights Under USERRA", where it is visible to employees such as a lobby or lunchroom.
