Question about overtime law

Hi, I have an employee who took two vacation days this week, on Monday and Tuesday. When she came back, she continued to work up until and including Saturday. Overall she ended up working her usual 40 hours for the week, but I'm not sure if Saturday counts as an overtime day or not, since she didn't actually work over 40 hours. Do I have to pay her an overtime wage for that day?



  • Since those days were considered vacation days, she didn't actually work above her 40 hours per week. Overtime is calculated based on the amount of hours worked within a week, and since she did not exceed this, you're not responsible for overtime.
