Can my boss demand that I split my tips at work?

I work in the East Village in New York at a small Restaurant. The manager recently asked me to split my tips with the kitchen staff. I don't really want to do that. What can I tell my boss?

  • According to Section 196-d of the NY State Labor Law: "No employer or his agent...shall demand or accept, directly or indirectly of any gratuities received by an employee" It seems that you can tell your manager that you don't want to share your tips, and that hey can't make you.
